WTVJ/NBC 6 Miami - Ultimate Honeymoon Giveaway Sweepstakes 2009

August 24, 2009 – September 20, 2009

PRELIMINARY INFORMATION:  NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.  Void outside the WTVJ terrestrial geographic viewing area (defined below) and where prohibited. The WTVJ/NBC 6 Miami - Ultimate Honeymoon Giveaway Sweepstakes 2009 (“Sweepstakes”) will be run in conjunction with the WTVJ/NBC 6 Miami - Ultimate Honeymoon Giveaway Contest 2009, and will consist of two (2) phases. The first phase begins at August 24, 2009 at 12:00:01 P.M. ET and ends on September 6, 2009 at 11:59:59 P.M. ET (“Phase 1”). The second phase begins at 12:00:01 P.M. on September 9, 2009 and ends at 11:59:59 P.M. on September 20, 2009 (“Phase 2”) (collectively, the “Sweepstakes Period”). Odds of winning Phase 1 Prize (as defined below) depends on the total number of eligible entries received for Phase 1. Odds of winning Phase 2 Prize (as defined below) depends on the total number of eligible entries received during the entire Sweepstakes Period. All times in the Sweepstakes refer to Eastern Time (“ET”). Sweepstakes is subject to all applicable federal, state and local laws.

ELIGIBILITY: Open only to permanent, legal U.S. residents who are twenty-one (21) years of age or older as of August 24, 2009, and who are physically located and residing in the WTVJ/NBC6 terrestrial geographic viewing area (the counties of Monroe, Miami-Dade, and Broward in the state of Florida (“Geographic Area”)). Entrants must have a valid Social Security Number or a valid U.S. personal tax identification number. Officers, directors, and employees of Sweepstakes Entities (as defined below), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and their spouses, regardless of where they reside), and/or persons living in the same households as such persons (whether or not related thereto) are ineligible to enter or win the Sweepstakes. Sweepstakes Entities, as referenced herein, shall include Sponsors (as defined below), The Factory Interactive, Inc., 3301 NE 1st Avenue, Penthouse 2, Miami, FL 33137; Web Services, LLC, 2201 Wilton Drive
Ft Lauderdale FL 33305; American Airlines, 901 Ponce de Leon Blvd., Suite 600, Coral Gables, FL  33143; The Landings St. Lucia, Rodney Bay Castries, Saint Lucia, West Indies; the Consulate General of Antigua and Barbuda, 25 SE 2nd Ave. Miami, FL 33131; Barbados Tourism Authority-Florida, 6100 S Falls Circle Drive, Suite 311, Ft. Lauderdale, FL 33319, (collectively, “Prize Suppliers”) and their respective parent, subsidiary, and affiliate companies, their respective administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes.
TO ENTER PHASE 1: To enter Phase 1, access the WTVJ website at www.nbcmiami.com (“Web Site”) and search for the keyword “Honeymoon” to access the Ultimate Honeymoon home page. After being redirected to the Sweepstakes home page, registered entrants may then enter the Sweepstakes by entering their email address and password, and then voting for their favorite couple competing in the Ultimate Honeymoon Giveaway Contest (“Phase 1 Entry”). To register, complete and thereafter submit the registration form. Information required on the registration form consists of your complete first and last name, complete address (including Zip Code), daytime telephone number (including area code), date of birth, email address, and a password of your choice (“Registration Information”). You must be registered with the Web Site to enter the Sweepstakes.  Phase 1 Entries must be received by 11:59:59 p.m. on September 6, 2009. You may enter once per day during Phase 1 of the Sweepstakes. All eligible, non-winning Entries received during Phase 1 will be retained and included in the subsequent Phase 2 drawing.
TO ENTER PHASE 2: To enter Phase 2, beginning at 12:00:01 P.M. on September 9, 2009, access the Web Site and search for the keyword “Honeymoon” to access the Ultimate Honeymoon home page. After being redirected to the Sweepstakes home page, registered entrants may then enter the Sweepstakes by entering their email address and password and then clicking the ENTER button (“Phase 2 Entry”). To register, complete and thereafter submit the registration form.  Information required on the registration form consists of your complete first and last name, complete address (including Zip Code), daytime telephone number (including area code), date of birth, email address, and a password of your choice (“Registration Information”). You must be registered with the Web Site to enter the Sweepstakes. Phase 2 Entries must be received by 11:59:59 p.m. on September 20, 2009. You may enter once per day during Phase 2 of the Sweepstakes.
Multiple Entries received from any person or unique email address beyond the above limits will void all such additional Entries. All required Entry Information must be completed in full. Any attempted form of entry other than as described herein is void. All Entries become the property of WTVJ, 15000 SW 27th Street, Miramar, FL 33027 and NBC Universal, Inc., 30 Rockefeller Plaza, New York, NY 10112 and will not be acknowledged. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. If there is a dispute as to the identity of an entrant who made a potentially winning Entry, Sponsors will deem that the Entry was made by the authorized account holder of the email address indicated in such Entry. The “authorized account holder” is defined as the natural person to whom the email address is assigned by an Internet service provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.  Except where prohibited by law or Sponsors’ Privacy Policies, Entry constitutes permission to use entrant’s name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.

PRIVACY: Any personal information supplied by entrant to Sponsors will be subject to Sponsors’ respective Privacy Policies posted at: http://www.nbcmiami.com/privacy and http://www.nbc.com/Footer/Privacy/. Entrants will have the opportunity to receive information from Sponsors and selected partners by checking the appropriate box(es). Doing so is optional and will not affect your chances of winning. If, at any time, you no longer wish to receive materials from Sponsors and selected partners, please go to their respective Privacy Policies and follow the procedures indicated.
WINNER SELECTION AND NOTIFICATION: Potential winners will be selected in two (2) random drawings, one (1) drawing for Phase 1 and one (1) drawing for Phase 2.
Phase 1: On or about September 8 2009, one (1) potential prize winner will be selected in a random drawing by Sponsors’ representatives from all eligible entries received from the Geographic Area during Phase 1 of the Sweepstakes. All eligible, non-winning Entries received during Phase 1 will be retained and included in the Phase 2 drawing.
Phase 2: On or about September 28 2009, one (1) potential prize winner will be selected in a random drawing by Sponsors’ representatives from all eligible entries received from the Geographic Area during the entire Sweepstakes Period.

Sponsors will make two (2) attempts within a twenty-four (24) hour period to notify each potential winner at the phone number submitted at the time of entry. Each potential winner will be required to execute and return (via shipping service pre-paid by Sponsors) an Affidavit of Eligibility, Liability Release, Publicity Release (where legal) and any other documentation that Sponsors may require (collectively, “Sweepstakes Documents”) within five (5) days after receipt of those documents by a potential winner or such potential winner may be disqualified and an alternate potential winner may be selected in a random drawing from among the remaining eligible Entries at Sponsors’ sole discretion. By returning the completed Sweepstakes Documents, each potential winner attests to the authenticity of his/her Entry. If a potential winner cannot be reached, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, and/or if his/her prize notification is returned as undeliverable, such potential winner will be disqualified and, time permitting, an alternate potential winner may be selected in a random drawing from among the remaining eligible Entries at Sponsors’ sole discretion. Sweepstakes Documents will be shipped to an address in the Geographic Area only.

PRIZES/ODDS OF WINNING: There will be two (2) prizes awarded (one (1) prize for Phase 1 (“Phase 1 Prize”) and one (1) prize for Phase 2 (“Phase 2 Prize”)). Winner of Phase 1 will be offered one (1) of the destinations (each a “Destination”) shown on the list below. Of the Destinations listed, the Phase 1 Winner will not be offered the Destination that was claimed by the winner of the WTVJ/NBC 6 Miami - Ultimate Honeymoon Giveaway Contest 2009, a separate promotion that has already run and awaits a selection of a winner and the winner’s selection of a Destination from the list below (see below).
Winner of Phase 2 will also be offered one of the Destinations shown on the list of Destinations below (see below), selected by Sponsors at their sole discretion. Of the Destinations, the Phase 2 Winner will not be offered the Destination that was claimed by the winner of the Ultimate Honeymoon Giveaway Contest 2009 and will not be offered the Destination that was claimed by the Winner of Phase 1. Limit one (1) Prize per person; limit one (1) Prize per household.
PRIZE: There will be two (2) prizes (each a “Prize”) awarded. Winner and his/her one (1) guest (“Guest”) will select one (1) trip from the remaining unclaimed trip(s) among the following three (3) trips (subject to Sponsors’ approval):

Trip #1: A five (5) night stay for Winner and Guest at the Carlisle Bay Resort in Antigua (“Antigua Trip”). Antigua Trip includes coach-class air transportation for Winner and Guest from a major U.S. gateway commercial airport near Winner’s residence (as determined by Sponsors in their sole discretion) to a major commercial airport in Antigua (as determined by Sponsors in their sole discretion); deluxe hotel accommodations (Ocean Suite/double occupancy) for five (5) nights at the Carlisle Bay Resort (“Antigua Hotel”); and daily breakfast, lunch, afternoon tea and dinner (alcoholic beverages not included) at Indigo on the Beach Bar or East Restaurant at the Antigua Hotel.  One (1) dinner will be arranged on the beach in a romantic Honeymoon setting at the Antigua Hotel. Antigua Trip travel is available beginning on January 3, 2010 and must be completed by December 31, 2010. The Approximate Retail Value (“ARV”) of Antigua Trip is eleven thousand eight hundred thirty dollars ($11,830).

Trip #2: A four (4) night stay for Winner and Guest at The Landings Resort St. Lucia, (“St. Lucia Trip”). St. Lucia Trip includes coach-class air transportation for Winner and Guest from a major U.S. gateway commercial airport near Winner’s residence (as determined by Sponsors in their sole discretion) to a St. Lucia, West Indies area airport (as determined by Sponsors in their sole discretion), and deluxe hotel accommodations (single room /double occupancy) for four (4) nights at The Landings Resort (“St. Lucia Hotel”). The ARV of St. Lucia Trip is four thousand three hundred dollars ($4,300).

Trip #3: A seven (7) night stay for Winner and Guest at The Colony Club Hotel in Barbados (“Barbados Trip”).  Barbados Trip includes coach-class air transportation for Winner and Guest from a major U.S. gateway commercial airport near Winner’s residence (as determined by Sponsors in their sole discretion) to a Barbados area airport (as determined by Sponsors in their sole discretion); round-trip ground transportation between the Barbados area airport and the Colony Club Hotel; seven (7) nights accommodations in an ocean-view room (single room/double occupancy); daily breakfast; complimentary water sports; complimentary water taxi between select Elegant Hotels west coast hotels; flower wrap on bed at arrival; one (1) dinner for Winner and Guest (alcoholic beverages not included); and keepsake gift upon departure (actual keepsake gift to be determined by Prize Supplier in their sole discretion) The ARV of Barbados Trip is seven thousand two hundred fifty dollars ($7,250).

ARV of all Prizes is twenty-three thousand three hundred eighty dollars ($23,380). Winner and Guest must comply with all applicable Prize Supplier rules and failure to do so may result in forfeiture of Prize. If a Prize element is not available for any reason, as determined by Sponsors in their sole discretion, the remaining elements of Prize shall be awarded and shall constitute full satisfaction of Sponsors’ Prize obligation to Winner and no additional compensation will be awarded. Additional restrictions may apply. ARV of Prize varies depending on the point of departure, point of arrival, and fare fluctuation for the Trip. Any differences between stated ARV and actual ARV will not be awarded. Winner will receive an IRS Form 1099 from Sponsors for the total ARV of Prize for the calendar year in which Prize was won. All Prize details will be determined by Sponsors in their sole discretion. Sponsors reserve the right to substitute a Prize (or Prize element) of comparable or greater value for any reason at their sole discretion. All taxes and other unspecified expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. Unless specified otherwise, trip must be completed within one (1) calendar year from award date or Prize will be forfeited.  Airline and hotel reservations are subject to availability. Trip must be booked as directed by Sponsors at least thirty (30) days prior to intended departure date. Certain blackout periods and travel restrictions may apply. Travel and hotel arrangements will be determined by Prize Suppliers in their sole discretion. Once determined, no change, extension, or substitution of Trip dates is permitted, except by Sponsors in their sole discretion. Winner and Guest must travel together on the same itinerary. Except as indicated above, no other travel elements (including, without limitation, travel to and from the airport near to the Winner’s residence, insurance, gasoline, meals, gratuities, souvenirs, etc.) are included in Prize. Tickets are non-refundable and are not valid for business-related or group travel. Tickets are valid only for travel on the airline(s) chosen by Prize Suppliers in their sole discretion. Tickets will be issued only to Winner and Guest. Winner is responsible for any tax liability, including applicable departure taxes or fees, inspection charges, and security charges. Once issued, tickets are non-transferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted. Winner and Guest are solely responsible for obtaining all necessary travel documents including passports. As of January 8, 2007, the U.S. State Department requires all international travelers to present a government-issued passport for U.S. Customs re-entry after air, land or sea travel. For more information please visit the State Department’s consular web site, http://www.travel.state.gov, or the U.S. Department of Homeland Security’s web site, http://www.dhs.gov. Winner and Guest must have valid travel documents (e.g., valid government-issued photo identification and passport) prior to departure. Prize consists only of the elements set forth above. Travel arrangements must be made through Prize Suppliers. Any illustrations and/or depictions of Prize are for illustrative purposes only and Prize element images shown in any promotional material may not be actual Prize elements awarded.  Sponsors are not responsible for airline seat assignments, special meals, check-in procedures, and baggage limitations.  Sponsors have no responsibility for alterations to any travel plans caused by airline delays or for any act, omission or event. Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize, and are not responsible or liable for any expenses incurred as a consequence thereof. Winner and Guest specifically release Sponsors from any and all claims for loss or damage to baggage or property, or from personal injuries or death, or from loss or delay, arising out of the acts, omissions, or negligence of any independent contractors, such as air carriers, hotels, restaurateurs, transportation providers, medical personnel or other providers of services or facilities. If a Winner chooses to take the Trip with no Guest, the remaining elements of the Prize shall be awarded and shall constitute full satisfaction of Sponsors’ Prize obligation to Winner and no additional compensation will be awarded. Guest, if any, will be required to execute and return a release of liability and, except where prohibited, publicity release (collectively, the “Guest Documents”), which must be returned with the Sweepstakes Documents, or Guest portion of Prize will be forfeited. Guest must be the age of majority in his or her state of residency as of the first date of travel or Winner must be Guest’s parent or legal guardian and must complete and return the Guest Documents on behalf of such minor Guest.

CONDITIONS: By entering the Sweepstakes, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Sweepstakes Entities and their respective officers, directors, employees, shareholders, representatives, and agents (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, misuse, or inability to use Prize (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by the Prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such entrant’s name on the Web Site and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission or approval and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error herein or in the Sweepstakes itself, and to be bound by all actions of the Sponsors, whose decisions are binding and final on all matters related to this Sweepstakes. Failure to comply with these conditions may result in disqualification from the Sweepstakes at Sponsors’ sole discretion.

ADDITIONAL TERMS: Sponsors reserve the right to terminate the Sweepstakes or permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules.  Any attempt to deliberately damage the Sweepstakes or operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law.  Sponsors reserve the right to cancel, suspend, or modify the Sweepstakes should any computer virus, malfunction, or other cause beyond their control corrupt the administration, security, or proper operation thereof.  In the event of such cancellation, suspension, or modification, Prize(s) may be awarded in a random drawing from among all eligible, non-suspect Entries received prior to the event requiring cancellation, suspension, or modification. Notice of cancellation, suspension, or modification will be posted on the Web Site. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer and/or telephone relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes. Released Parties are not responsible for telecommunications, network, electronic, technical, mobile telephone service, or computer failures of any kind; for inaccurate transcription of Entry Information; for errors in any promotional, marketing, or prize notification or fulfillment materials or in these Official Rules; for any human or electronic error; or for Entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors may prohibit any entrant or potential entrant from participating in the Sweepstakes, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion).

DISPUTES: The Sweepstakes is governed by, and will be construed in accordance with, the laws of the State of New York, and the forum and venue for any dispute shall be in New York, New York. If THE controversy or claim is not otherwise resolved through direct discussions or mediation, it shall THEN be resolved by FINAL AND binding arbitration administered by JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“JAMS Rules”).  The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in new york.  All proceedings brought pursuant to this paragraph will be conducted in the County of new york.  THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.

The WTVJ/NBC 6 Miami - Ultimate Honeymoon Giveaway Contest 2009 ("Contest") begins on July 27, 2009 at 12:00:01 A.M. ET and ends on August 16, 2009 at 11:59:59 P.M. ET ("Contest Period"). All times in the Contest refer to Eastern Time ("ET"). Contest is subject to all applicable federal, state and local laws.

ELIGIBILITY: Entrant and his/her fiancée/fiancé must both be (a) permanent, legal U.S. residents who are located and residing in the WTVJ/NBC6 terrestrial geographic viewing area in the counties of Monroe, Miami-Dade, and Broward in the state of Florida ("Geographic Area"); (b) twenty-one (21) years of age or older as of July 27, 2009; (c) unmarried as of July 27, 2009 and during the Contest Period (entrant and his/her fiancée/fiancé may become married to each other after August 16, 2009); (d) engaged to each other at all times during the Contest Period (entrant and his/her fiancée/fiancé may become married to each other after August 16, 2009); (e) legally eligible to be married to each other under the laws of the State of Florida during the Contest Period; and (f) must have either a valid Social Security Number and/or a valid U.S. personal tax identification number. Officers, directors, and employees of Contest Entities (as defined below), members of these persons' immediate families (spouses and/or parents, children, and siblings, and their spouses, regardless of where they reside), and/or persons living in the same households as such persons (whether or not related) are ineligible to enter or win the Contest. TO ENTER: To enter, access the WTVJ website at www.nbcmiami.com ("Web Site") and search for the keyword "Honeymoon" to access the Contest home page. Then follow the provided instructions to complete and thereafter transmit the entry form. Information required on the entry form (collectively "Entry Information") consists of your first and last name, your fiancée's/fiancé's first and last name, complete address (including Zip Code), telephone number (including area code), date of birth, email address, your wedding date, and an essay, written in the English language, describing why you believe that you and your fiancée/fiancé most deserve to receive an Ultimate Honeymoon Vacation ("Essay"). Entry Information and Essay will together constitute an entry into this Contest ("Entry"). All Entries become the property of WTVJ, 15000 SW 27th Street, Miramar, FL 33027, and NBC Universal, Inc., 3000 West Alameda Avenue, Burbank, CA 91523 (collectively, "Sponsors"), and will not be acknowledged or returned. Essays must be the entrant's sole and original work (that is, written only by the entrant) and must be no more than one hundred fifty (150) words in length. If an Essay exceeds one hundred fifty (150) words, only the first one hundred fifty (150) words of the Essay will be judged. Information stated in the Entry must be truthful and is subject to verification by Sponsors. By submitting an Essay, each entrant grants Contest Entities and those authorized by them permission to post, print, display or read the Essay on the Internet, in print media, and/or broadcast on television, radio or otherwise exploit the Essay for public viewing/listening. Essays may be shortened, edited, modified, or otherwise changed at Sponsor's sole discretion, without the approval of entrants. Entrants warrant that such use by Contest Entities will not result in any liability to Contest Entities, and agree to indemnify Contest Entities from and against any liability resulting from such use. Entrants agree that Sponsors shall have no obligation to copy, publish, display, or otherwise exploit the Essays. Essays must not include materials (language, phrases, quotations, etc.) belonging to or copyrighted by third parties; any such Essays containing third-party materials will be disqualified. Essays must not have been previously published, performed, submitted in any competition or otherwise exhibited. Essays must not contain the name of any fictitious character(s). Each entrant warrants that he/she has obtained permission from the his/her fiancée/fiancé to submit an Essay in the Contest and entrant's fiancée/fiancé has agreed to the use of his/her identity in connection with the Contest, Essay and the uses of the Essay as contemplated herein without further compensation or permission. Essays must not contain the name of any person, living or dead, unless such person has consented to such use. Essays must not contain any material that infringes upon any personal, proprietary, or any other right of any third party. Essays must not contain any obscene or otherwise objectionable material (as determined by Sponsors within their sole discretion), references to alcoholic beverages, tobacco, drug paraphernalia, firearms, or any description or representation thereof. Essays must not contain any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation, and must not portray Contest Entities in a negative light (as determined by Sponsors in their sole discretion). Essays must not contain any material that: (a) would give or threaten to give rise to criminal or civil liability; (b) encourages conduct that constitutes a criminal offense; or (c) encourages or provides instructional information about illegal activities.

Entries must be received by August 16, 2009 at 11:59:59 P.M. ET to be eligible for the Contest. Limit one (1) Entry per person and per email address during the entire Contest Period. If more than one Entry is received from the same person or email address, only the first Entry received will be considered and all subsequent Entries will be disqualified. Essays that are not reasonably pertinent to the Judging Criteria (described below), as determined by Sponsors in their sole discretion, or are otherwise in violation of these Official Rules will be disqualified.

PRIVACY: Any personal information supplied by entrant to Sponsors will be subject to Sponsors' respective Privacy Policies posted at: http://www.nbcmiami.com/privacy and http://www.nbc.com/Footer/Privacy/. Entrants will have the opportunity to receive information from Sponsors and selected partners by checking the appropriate box(es). Doing so is optional and will not affect your chances of winning. If, at any time, you no longer wish to receive materials from Sponsors and selected partners, please go to their respective Privacy Policies and follow the procedures indicated.

WINNER SELECTION AND NOTIFICATION: Initial Judging: On or about July 27, 2009, and continuing until on or about August 17, 2009, all eligible Essays received from entrants within the Geographic Area during the entire Contest Period will be judged on a rolling basis by one (1) or more judges ("Initial Judge(s)"). Essays will be judged based upon the following judging criteria: 1) compelling original story (40 points); 2) degree to which entrant and his/her fiancée/fiancé deserves to win an Ultimate Honeymoon vacation (30 points); and 3) clarity of expression (30 points) ("Judging Criteria") for a maximum possible total of one hundred (100) points. Ties will be broken as follows ("Tie Breaking Procedure"): In the event of a tie, the tied Essay that received the most "compelling original story" points will win the tie-breaker. In the event of a further tie, the tied Essay that received the most "degree to which entrant and his/her fiancé/fiancée deserves to win an Ultimate Honeymoon vacation" points will win the tie-breaker. In the event of a further tie, the tied Essay that received the most "clarity of expression" points will win the tie-breaker. In the event of any remaining tie, the tied Essays will be re-scored as above until the tie is broken. The four (4) Essays that received the highest overall scores (or who win in the Tie Breaking Procedure if there is a tie for the highest overall score) in the Initial Judging will be named finalists ("Finalists") subject to confirmation of eligibility and compliance with these Official Rules. Initial Judges have the right in their sole discretion to select fewer than four (4) Finalists (or no Finalist at all) based on an insufficient number of qualified Essays received and/or if fewer than four (4) Essays score the minimum required total of at least sixty (60) points. Subject to confirmation of eligibility and compliance with these Official Rules, each Finalist will go on to the Grand Prize Voting stage.

Notification of Potential Finalists: On or about August 17, 2009, Sponsors' representatives will attempt to notify each potential Finalist by phone (at the phone number provided at time of Entry). Each potential Finalist will be required to return (via shipping service pre-paid by Sponsors) an Affidavit of Eligibility, Liability Release, Publicity Release (where legal), an IRS W-9 Form and any other documentation that Contest Entities may require (collectively, "Finalist Documents") within two (2) days after such notification. Potential Finalists may also be required to fax the completed Finalist Documents to Sponsors or Sponsors' representatives within twenty-four (24) hours of receipt of these documents by a potential Finalist. Faxed Contest Documents will have the same force and effect as the originals. If a potential Finalist fails to execute and return the required Finalist Documents within the prescribed time period, if a potential Finalist is found to be ineligible, if a potential Finalist cannot or does not comply with these Official Rules, and/or if a potential Finalist notification is returned as undeliverable, such potential Finalist will be disqualified and the entrant whose Essay received the next highest score based on the Judging Criteria may, at Sponsors' sole discretion, be declared a potential Finalist. Finalists will also be required submit an actual photograph or submit a digital photo ("Photo") via email to the email address provided by Sponsors at the time of notification. By providing a Photo, each entrant and his/her fiancée/fiancé grants Contest Entities and those authorized by them permission to post, print, or display the Photo on the Internet, in print media, and/or broadcast on television, radio or otherwise exploit the Photo for public viewing. Photos may be edited, modified, or otherwise changed at Sponsors' sole discretion, without the approval of entrants. Entrants warrant that such use by Contest Entities will not result in any liability to Contest Entities, and agrees to indemnify Contest Entities from and against any liability resulting from such use. Entrants agree that Sponsors shall have no obligation to copy, publish, display, or otherwise exploit the Photos. Photos must not include images (logos, slogans, etc.) belonging to or copyrighted by third parties; any such Photos containing third-party materials will be disqualified. Photos must not contain the likeness of any person, living or dead, unless such person has consented to such use. Photos must not contain any material that infringes upon any personal, proprietary, or any other right of any third party. Photos must not contain any obscene or otherwise objectionable material (as determined by Sponsors within their sole discretion), references to alcoholic beverages, tobacco, drug paraphernalia, firearms, or any description or representation thereof. Photos must not contain any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation, and must not portray Contest Entities in a negative light (as determined by Sponsors in their sole discretion). Photos must not contain any material that: (a) would give or threaten to give rise to criminal or civil liability; (b) encourages conduct that constitutes a criminal offense; or (c) encourages or provides instructional information about illegal activities. Photos submitted by each Finalist couple must not be a professional photograph and by submitting the photograph, each Finalist couple represents and warrants that they own all rights to the Photo and must grant Sponsors any and all rights without any monetary compensation to publish, broadcast, reprint and distribute Photo in any and all media in perpetuity for any purpose. If a potential Finalist cannot be reached, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, if his/her Finalist Documents are returned as undeliverable, such potential Finalist will be disqualified and the entrant that submitted the Essay with the next highest score based on the Judging Criteria may be selected as an alternate potential Finalist. Finalists and his/her fiancée/ fiancé must be available to appear in studio at NBC6/WTVJ, 15000 SW 27th Street, Miramar, FL 33027, on Monday August 24, 2009 from 10:00 A.M. to 12:00 P.M. for the on-air announcement of the four (4) Finalists. Unavailability to appear at the studio on this date may result in disqualification, as determined at Sponsors' sole discretion. Finalist notification and Finalist Documents will only be mailed/shipped to an address within the Geographic Area only.

Grand Prize Voting/Judging: Beginning on or about August 24, 2009 at 12:00:01 P.M. and continuing until 11:59:59 P.M. on or about September 6, 2009 ("Voting Period"), the Entries from all four (4) Finalists, including Essays, Photos, and any other relevant information as determined by Sponsors in their sole discretion, will be posted on the Web Site for public viewing and voting during the Voting Period. During the Voting Period, eligible voters may go to the Web Site then complete and thereafter submit the voting form ("Voting Form"). Information required on the Voting Form (collectively "Voting Information") consists of your first and last name, complete address (including Zip Code), telephone number (including area code), date of birth, email address and the Finalist couple for which the voter would like to cast his/her vote. Finalist essays will be voted on by the public based upon the following suggested criteria: 1) compelling original story; 2) degree to which entrant and his/her fiancée/fiancé deserves to win an Ultimate Honeymoon vacation; and 3) clarity of expression. Members of the public who are eighteen (18) years of age or older as of August 24, 2009, and permanent, legal U.S. residents are eligible to vote. Each Finalist may vote for his/her own Entry in accordance with these Official Rules. All votes must be submitted by 11:59:59 P.M. on September 6, 2009. Limit one (1) vote per person and/or per email address per day during the Voting Period. Multiple votes received from any person or email address beyond this limit will be disqualified. Votes generated by a script, macro, or other automated means will be disqualified. Votes that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion (including, without limitation, at Sponsors' and/or any other entity's servers), are void and will not be accepted. The Finalist who receives the most votes during the Voting Period, as determined by Sponsors in their sole discretion, will be named the potential winner ("Winner") subject to verification of eligibility and compliance with these Official rules. In the event of a tie the tied Finalist Entries will be judged by an additional tie-breaking judge using the Judging Criteria described above to determine which of the tied Finalists will be named the potential Winner. On or about September 7, 2009, Sponsors' representatives will make two (2) attempts to notify the potential Winner by phone (at the phone number provided on Winner's entry). If potential Winner cannot be reached or if his/her prize or prize notification is returned as undeliverable, such potential Winner will be disqualified and the Finalist that received the next highest amount of votes during the Voting Period will be selected as an alternate potential Winner, subject to verification of eligibility and compliance with these Official Rules, at Sponsors' sole discretion.

PRIZE: There will be one (1) prize ("Prize") awarded. Winner and his/her fiancée/fiancé ("Guest") will select one (1) trip from the following three (3) choices (subject to Sponsors' approval):

Choice #1: A five (5) night stay for Winner and Guest at the Carlisle Bay Resort in Antigua ("Antigua Trip"). Antigua Trip includes coach-class air transportation for Winner and Guest from a major U.S. gateway commercial airport near Winner's residence (as determined by Sponsors in their sole discretion) to a major commercial airport in Antigua (as determined by Sponsors in their sole discretion); deluxe hotel accommodations (Ocean Suite/double occupancy) for five (5) nights at the Carlisle Bay Resort ("Antigua Hotel"); and daily breakfast, lunch, afternoon tea and dinner (alcoholic beverages not included) at Indigo on the Beach Bar or East Restaurant at the Antigua Hotel. One (1) dinner will be arranged on the beach in a romantic Honeymoon setting at the Antigua Hotel. Antigua Trip travel is available beginning on January 3, 2010 and must be completed by December 31, 2010. The Approximate Retail Value ("ARV") of Antigua Trip is eleven thousand eight hundred and thirty dollars ($11,830).

Choice #2: A four (4) night stay for Winner and Guest at The Landings Resort St. Lucia, ("St. Lucia Trip"). St. Lucia Trip includes coach-class air transportation for Winner and Guest from a major U.S. gateway commercial airport near Winner's residence (as determined by Sponsors in their sole discretion) to a St. Lucia, West Indies area airport (as determined by Sponsors in their sole discretion), and deluxe hotel accommodations (single room /double occupancy) for four (4) nights at The Landings Resort ("St. Lucia Hotel"). The ARV of St. Lucia Trip is four thousand three hundred dollars ($4,300).

Choice #3: A seven (7) night stay for Winner and Guest at The Colony Club Hotel in Barbados ("Barbados Trip"). Barbados Trip includes coach-class air transportation for Winner and Guest from a major U.S. gateway commercial airport near Winner's residence (as determined by Sponsors in their sole discretion) to a Barbados area airport (as determined by Sponsors in their sole discretion); round-trip ground transportation between the Barbados area airport and the Colony Club Hotel; seven (7) nights accommodations in an ocean-view room (single room/double occupancy); daily breakfast; complimentary water sports; complimentary water taxi between select Elegant Hotels west coast hotels; flower wrap on bed at arrival; one (1) dinner for Winner and Guest (alcoholic beverages not included); and keepsake gift upon departure (actual keepsake gift to be determined by Prize Supplier in their sole discretion) The ARV of Barbados Trip is seven thousand two hundred fifty dollars ($7,250).

Sponsors reserve the right to substitute a similar prize of equal or greater value at their sole discretion. Winner and Guest must comply with all applicable Prize Supplier rules and failure to do so may result in forfeiture of Prize. If a Prize element is not available for any reason, as determined by Sponsors in their sole discretion, the remaining elements of Prize shall be awarded and shall constitute full satisfaction of Sponsors' Prize obligation to Winner and no additional compensation will be awarded. Additional restrictions may apply. ARV of Prize varies depending on the point of departure, point of arrival, and fare fluctuation for the Trip. Any differences between stated ARV and actual ARV will not be awarded. Winner will receive an IRS Form 1099 from Sponsors for the total ARV of Prize for the calendar year in which Prize was won. All Prize details will be determined by Sponsors in their sole discretion. Sponsors reserve the right to substitute a Prize (or Prize element) of comparable or greater value for any reason at their sole discretion. All taxes and other unspecified expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. Unless specified otherwise, trip must be completed within one (1) calendar year from award date or Prize will be forfeited. Airline and hotel reservations are subject to availability. Trip must be booked as directed by Sponsors at least thirty (30) days prior to intended departure date. Certain blackout periods and travel restrictions may apply. Travel and hotel arrangements will be determined by Prize Suppliers in their sole discretion. Once determined, no change, extension, or substitution of Trip dates is permitted, except by Sponsors in their sole discretion. Winner and Guest must travel together on the same itinerary. Except as indicated above, no other travel elements (including, without limitation, travel to and from the airport near to the Winner's residence, insurance, gasoline, meals, gratuities, souvenirs, etc.) are included in Prize. Tickets are non-refundable and are not valid for business-related or group travel. Tickets are valid only for travel on the airline(s) chosen by Prize Suppliers in their sole discretion. Tickets will be issued only to Winner and Guest. Winner is responsible for any tax liability, including applicable departure taxes or fees, inspection charges, and security charges. Once issued, tickets are non-transferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted. Winner and Guest are solely responsible for obtaining all necessary travel documents including passports. As of January 8, 2007, the U.S. State Department requires all international travelers to present a government-issued passport for U.S. Customs re-entry after air, land or sea travel. Winner and Guest must have valid travel documents (e.g., valid government-issued photo identification and passport) prior to departure. Prize consists only of the elements set forth above. Travel arrangements must be made through Prize Suppliers. Any illustrations and/or depictions of Prize are for illustrative purposes only and Prize element images shown in any promotional material may not be actual Prize elements awarded. Sponsors are not responsible for airline seat assignments, special meals, check-in procedures, and baggage limitations. Sponsors have no responsibility for alterations to any travel plans caused by airline delays or for any act, omission or event. Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize, and are not responsible or liable for any expenses incurred as a consequence thereof. Winner and Guest specifically release Sponsors from any and all claims for loss or damage to baggage or property, or from personal injuries or death, or from loss or delay, arising out of the acts, omissions, or negligence of any independent contractors, such as air carriers, hotels, restaurateurs, transportation providers, medical personnel or other providers of services or facilities. If a Winner chooses to take the Trip with no Guest, the remaining elements of the Prize shall be awarded and shall constitute full satisfaction of Sponsors' Prize obligation to Winner and no additional compensation will be awarded. Guest, if any, will be required to execute and return a release of liability and, except where prohibited, publicity release (collectively, the "Guest Documents"), which must be returned with the Sweepstakes Documents, or Prize will be forfeited and an alternate potential winner may be selected from the remaining eligible entries at Sponsors' sole discretion.

CONDITIONS: By entering the Contest, each entrant agrees for entrant and for entrant's heirs, executors, and administrators (a) to release and hold harmless Contest Entities and their respective officers, directors, employees, shareholders, representatives, and agents (collectively, "Released Parties") from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant's participation in the Contest and/or his/her acceptance, possession, use, misuse, or inability to use Prize (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Contest and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by the Prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such entrant's name on the Web Site and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission or approval and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error herein or in the Contest itself, and to be bound by all actions of the Sponsors, whose decisions are binding and final on all matters related to this Contest. Failure to comply with these conditions may result in disqualification from the Contest at Sponsors' sole discretion.

ADDITIONAL TERMS: Sponsors reserve the right to terminate the Contest or permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Contest or operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. Sponsors reserve the right to cancel, suspend, or modify the Contest should any computer virus, malfunction, or other cause beyond their control corrupt the administration, security, or proper operation thereof. In the event of such cancellation, suspension, or modification, Prize(s) may be awarded in a random drawing from among all eligible, non-suspect Entries received prior to the event requiring cancellation, suspension, or modification. Notice of cancellation, suspension, or modification will be posted on the Web Site. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities (excepting compliance with applicable codes and regulations), or other "force majeure" event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants' or to any other person's computer and/or telephone relating to or resulting from entering or downloading materials or software in connection with the Contest. Released Parties are not responsible for telecommunications, network, electronic, technical, mobile telephone service, or computer failures of any kind; for inaccurate transcription of Entry Information; for errors in any promotional, marketing, or prize notification or fulfillment materials or in these Official Rules; for any human or electronic error; or for Entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors may prohibit any entrant or potential entrant from participating in the Contest, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors' agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion).

DISPUTES: THE CONTEST IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF ("JAMS RULES"). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY'S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
